Investigation of Applications Made Pursuant to The Trade Union Act, The Construction Industry Labour Relations Act, 1992 and/or The Health Labour Relations Reorganization Act

Board Resolution:

Be it resolved:

THAT the Board authorizes any person, appointed by the Chairperson or Vice-Chairperson, to act as investigating officer and duly appointed Board agent pursuant to s. 18 of The Trade Union Act and to exercise the following powers or functions on behalf of the Board in relation to any proceeding brought pursuant to The Trade Union Act, The Construction Industry Labour Relations Act, 1992 and/or The Health Labour Relations Reorganization Act:  

1.                  Order prehearing procedures, including pre-hearing conferences that are held in private, and direct the times, dates and places of the hearings for those procedures;

2.                  Make any examination of records and any inquiries that the investigating officer considers necessary; and

3.                  At any stage of a proceeding, compel any person to provide information or produce records and things that may be relevant to a matter before the Board, after providing the parties an opportunity to make representations.
