When the Chairperson of the Board is asked to appoint an arbitrator or a member of an arbitration board pursuant to s. 26.1 of The Trade Union Act or pursuant to the collective agreement between the parties and the parties choose to advise the Chairperson of individuals previously put forward by one party and rejected by the other, the Chairperson will take note of those previous rejections but retains and may exercise the discretion to appoint an individual previously rejected.
